Elan found that the laptops on the market were equipped with touch IC manufactured and sold by FocalTech Systems Co.,Ltd. (hereinafter referred to as: FocalTech). Depending on the outside patent attorney’s opinion, the aforementioned touch IC has been found that it falls within the claim scope of Taiwan invention patent No. I662460 owned by Elan, and therefore infringes Elan’s patent rights. The accused touch IC is used in the touchpad module of a single model for gaming laptops. However, in order to properly enforce Elan’s intellectual property rights to prevent plagiarism from the competitors and maintain the long-term competitive advantage of Elan’s products, Elan decided to file this lawsuit.
