On 20 December 2023, the Central Administrative Court dismissed NT's petition to revoke the arbitration award and NT has subsequently filed an appeal against the Central Administrative Court's judgment with the Supreme Administrative Court. The Company would like to inform that on 12 July 2024, the Supreme Administrative Court dismissed NT's appeal. Consequently, the dispute is concluded and the Company is not obligated to pay the additional revenue share claimed by NT.공지 • Apr 27Advanced Info Service Public Company Limited Provides Update on Legal Dispute with National Broadcasting and Telecommunications CommissionAdvanced Info Service Public Company Limited announced that the Company filed a lawsuit to the Central Administrative Court on 18 December 2015 to revoke the National Broadcasting and Telecommunications Commission ("NBTC") announcement on "Consumer Protection for Temporary Period in case of Termination of Concession No. 2" in the clause stipulating that the Company shall, during the remedy period, pay a minimum revenue rate specified under the concession. The announcement prescribes the duty of the mobile telecommunication service provider to maintain its services to customers after concession expiry (the Company's concession expired at the end of September 2015), and to inform customers to migrate their services according to the plan as well as to submit a minimum revenue rate which was 30% of service revenue at the time. On 11 September 2019, the Central Administrative Court ruled, in favor of the Company, to revoke the clause under Announcement No.2 that stipulates a minimum revenue. Subsequently, the NBTC appealed this decision to the Supreme Administrative Court. The Company would like to inform that on 25 April 2024, the Supreme Administrative Court ordered the case to be removed from the registry. This decision was based on the fact that during the consideration of this case, the Supreme Administrative Court has made a final judgment in another case to revoke Announcement No.2 in such a clause, effective from 15 December 2023. Consequently, the Company is relieved of any obligation to comply with the revoked clause under Announcement No. 2. A cash consideration of THB 233.2 billion valued at THB 216.3 per share will be paid by Intouch Holdings Public Company Limited, Gulf Energy Development Public Company Limited and Singtel Strategic Investments Pte Ltd. As part of consideration, THB 233.2 billion is paid towards common equity of Advanced Info Service Public Company Limited. Under the terms of agreement, the acquisition of securities of Advanced Info Service Public Company Limited (“ADVANC”) by way of the conditional voluntary tender offer for all securities of ADVANC (excluding the shares held by tender offerors); As of August 27, 2024, the offer price has been revised to THB 211.43 per share. The adjustment of the tender offer price is based on the conditions as specified in the Notification to the SET from the declaration of the payment of interim dividend of ADVANCat the amount of THB 4.87 per share, pursuant to the resolution of the Board of Directors’ Meeting of ADVANC on 6 August 2024, which approved the payment of such interim dividend. The funds are entirely sourced from credit facilities provided by financial institutions. 공지 • Jul 12Advanced Info Service Public Company Limited Provides Update on Legal Dispute with National Telecom Public Company LimitedAdvanced Info Service Public Company Limited announced reference is made to the dispute that National Telecom Public Company Limited (NT) (formerly, TOT Public Company Limited) filed with the Arbitral Tribunal on 27 September 2018, claiming additional revenue share from roaming service from Advanced Info Service Public Company Limited (the Company) based on the 7th amendment to the main concession agreement for the period from July 2013 to September 2015 amounting to a total of THB 16,252 million, with a penalty interest rate of 1.25% per month. On 11 February 2020, the Arbitral Tribunal rendered an award in favor of the Company, dismissing NT's claims. NT filed a petition with the Central Administrative Court to revoke the arbitration award. On 20 December 2023, the Central Administrative Court dismissed NT's petition to revoke the arbitration award and NT has subsequently filed an appeal against the Central Administrative Court's judgment with the Supreme Administrative Court. The Company would like to inform that on 12 July 2024, the Supreme Administrative Court dismissed NT's appeal. Consequently, the dispute is concluded and the Company is not obligated to pay the additional revenue share claimed by NT.
공지 • Apr 27Advanced Info Service Public Company Limited Provides Update on Legal Dispute with National Broadcasting and Telecommunications CommissionAdvanced Info Service Public Company Limited announced that the Company filed a lawsuit to the Central Administrative Court on 18 December 2015 to revoke the National Broadcasting and Telecommunications Commission ("NBTC") announcement on "Consumer Protection for Temporary Period in case of Termination of Concession No. 2" in the clause stipulating that the Company shall, during the remedy period, pay a minimum revenue rate specified under the concession. The announcement prescribes the duty of the mobile telecommunication service provider to maintain its services to customers after concession expiry (the Company's concession expired at the end of September 2015), and to inform customers to migrate their services according to the plan as well as to submit a minimum revenue rate which was 30% of service revenue at the time. On 11 September 2019, the Central Administrative Court ruled, in favor of the Company, to revoke the clause under Announcement No.2 that stipulates a minimum revenue. Subsequently, the NBTC appealed this decision to the Supreme Administrative Court. The Company would like to inform that on 25 April 2024, the Supreme Administrative Court ordered the case to be removed from the registry. This decision was based on the fact that during the consideration of this case, the Supreme Administrative Court has made a final judgment in another case to revoke Announcement No.2 in such a clause, effective from 15 December 2023. Consequently, the Company is relieved of any obligation to comply with the revoked clause under Announcement No. 2. As a result, the legal dispute is considered concluded.

NT claimed that the Company was in breach of the concession agreement. Subsequently, on February 21, 2019, the Company received a unanimous resolution dismissing NT's claim, whereby NT filed a petition for revocation of the resolution to the Central Administrative Court on May 15, 2019. The Company informed that on September 22, 2023, the Central Administrative Court has dismissed NT's petition for revocation of the resolution. However, NT is eligible to file an appeal to the Supreme Administrative Court within 30 days. If there is any significant update, the Company shall inform accordingly.
