While the Company did not intend to engage in false, misleading or deceptive conduct, the Company apologises unreservedly to the Court and customers. The Company is committed to promoting a culture of compliance with all its legal obligations and will continue to work hard to comply with those obligations. Further it announced that judgment delivered in Proceeding No. NSD843/2022 brought by the Australian Securities and Investments Commission and ordered that the Company pay a pecuniary penalty of AUD 35 million; Latitude Financial Services pay a pecuniary penalty of AUD 20 million; Latitude Financial Services and the Company to pay ASIC’s costs in equal shares; and the Company use all reasonable endeavours to cause to be published an adverse publicity notice. The accounts of the Company in prior years had already recognised accruals totalling AUD 16.2 million in anticipation of this possible outcome.
