Eco-Shop Marketing Berhad Receives Writ of Summon and Statement of Claim

ECO-SHOP MARKETING BERHAD wishes to inform that the Company had on late evening of July 30, 2026 received a copy of the sealed Writ of Summon and Statement of Claim dated July 28, 2026 from Messrs Ismail, Khoo & Associates, acting on behalf of Mr. Cheng Heng Yew and Mr. Cheng Kar Tong (as attorney of Mr. Cheng Heng Yew), against ECO-SHOP, Eco-Shop Marketing Sdn Bhd, Kong Ken Meng, Chin Pik Fong, Low Wan Cheong and Lee Koi Chin. Both the Writ and Statement of Claim dated July 28, 2026 were served by Mr. Cheng Heng Yew’s solicitors, Messrs Ismail, Khoo & Associates on ECO-SHOP’s solicitors, Messrs Shook Lin & Bok, via email on July 30, 2026 thereby ECO-SHOP was informed of the service by its solicitors in the late evening of July 30, 2026, when the Cause Papers were forwarded to ECO-SHOP via email. The original hard copies of the Cause Papers were thereafter received by ECO-SHOP’s solicitors at their office at or about noon on July 31, 2026 via courier services. The claims pursuant to the Writ and Statement of Claim are as follows: A declaration that ECO-SHOP is required within two years, and as determined by the Honorable Court or at any time specified by the Honorable Court, to rebuild the building and/or premises No. 262 (Ground Floor and First Floor), Jalan Gurdwara, 10300 Georgetown, Penang, held under Lot 983 & 982 Bandar Georgetown, Section 11W, North-East District, Penang, owned by Mr. Cheng Heng Yew; and the Defendants are required to pay a monthly rent or monthly compensation of MYR 35,000 per month, or any amount determined by the Honorable Court per month, until the issuance of the Certificate of Completion and Compliance and for a minimum period of eighteen years as a guarantee that the Demised Premises are restored/restituted or rebuilt. An order that ECO-SHOP is required within a period of two years and as determined by the Honorable Court, or any time specified by the Honorable Court, to rebuild the Demised Premises owned by Mr. Cheng Heng Yew, and the Defendants are required to pay a monthly rent of MYR 35,000 per month or any amount determined by the Honorable Court per month until the issuance of the certificate of approval for occupancy of the said building or premises. An order that ECO-SHOP is required to deposit MYR 20 million or any amount as security to guarantee the restoration/restitution and/or reconstruction along with a Certificate of Completion and Compliance by the Penang Island City Council or any relevant party within seven days of the order into the account of Mr. Cheng Heng Yew and/or Mr. Cheng Kar Tong where the Defendants fail to comply with the completion within two years as provided or declared. An order that ECO-SHOP is required to provide a bank guarantee of MYR 20 million and/or any amount as a warranty/guarantee for the reconstruction of the Demised Premises and/or any warranty/guarantee for losses and damages in any manner whatsoever. A declaration that architect Low Wan Cheong and Engineer Lee Koi Chin, whether individually and/or jointly, are responsible and liable for all losses, damages, costs, and liabilities suffered by the Plaintiffs as a result of wrongful acts, mala fide (bad faith), unprofessionalism, breach of contract and/or warranty, negligence, as well as failure to comply with the terms and work requirements set by the Penang Island City Council, and to pay to the Plaintiffs all damages, costs, interest, and any other relief deemed just and fit by the Honorable Court. General damages. Damages for breach of agreement. Damages for economic loss. Damages for breach of duty. Specific damages amounting to MYR 5.184 million. Exemplary damages of MYR 10 million or any amount deemed fit and proper by the Honorable Court. Aggravated damages of MYR 10 million or any amount deemed fit and proper by the Honorable Court. Interest at the rate of 5% per annum on any monetary award from the period of April 22, 2025 until the date of full judgment. Costs; and Such further or other reliefs as the Honourable Court deems fit and proper to grant. The circumstances leading to the filing of the Writ and Statement of Claim against ECO-SHOP was due to the alleged breach of the Tenancy Agreement between ECO-SHOP and Mr. Cheng Heng Yew as well as unauthorised demolishment of the Demised Premises by ECO-SHOP, which allegedly resulted in losses suffered by Mr. Cheng Heng Yew. The Company is presently not able to ascertain the full financial impact arising from the claims as the matter is still at a preliminary stage and is subject to the outcome of the court proceedings. The claims, however, are not expected to have any material operational impact on ECO-SHOP Group. The Company is currently seeking the legal advice from its solicitors to resolve and/or defend against the claims.
