There May Be Life In The Busted Albertsons -- Kroger Deal

Summary We had predicted most of the arguments in the FTC's suit to enjoin the merger in September 2023. The judge's opinion reiterates many of the points we made. The biggest “winner” of the failed deal isn't The Kroger Co. or Albertsons Companies, Inc.  It's Walmart because the busted merger eliminates Walmart's most viable competitor. The judgment sliced and diced the antitrust definition of the “market” for groceries to a narrow sector of the industry, so that the merger could not help but be 'anti-competitive.' Consumers lost, in our opinion.  Unions won.  But a new FTC Chair may leave the door open to possibly revive the merger.
